Agreement

The ProStamm website and program are comprised of various pages, managed and operated by ProStamm, LLC.

The use of the ProStamm website and program is on the condition of the user’s acceptance without modification of the terms, condition, and notices contained herein.

Modification of These Terms of Use

ProStamm, LLC reserves the right to change the terms, conditions, and notices under which the ProStamm website and program are offered, including but not limited to the charges associated with the use of the ProStamm website and program. Users will be notified of potential changes.

Communication

User agrees that when using ProStamm, the user will not:

Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.

Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.

Upload files or other material protected by intellectual property laws (or by rights of privacy of publicity) unless the user owns or controls the rights thereto or has received all necessary consents.

ProStamm, LLC has no obligation to monitor user’s family information.

ProStamm, LLC reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process, or governmental request.

Always use caution when giving out personally identifying information about oneself or family members.

Materials Provided to the ProStamm Website

ProStamm, LLC is not in the business of selling family information or providing access to the general public. ProStamm, LLC does not claim ownership of the information, documents, and photographs provided to ProStamm, LLC.

The Primary Record Owner (PRO) is required to invite family members before they can become a Family Circle Full (FCF) and Family Circle Limited (FCL). Only the PRO and authorized family members may access family records.

If the PRO elects to invite family members to access the family record, ProStamm, LLC will provide access to those registered as a FCF or FCL. A FCF may view, download, and reproduce information, documents, photographs, and family presentations produced by the PRO and FCF. A FCL can only view the family record.

Liability Disclaimer

ProStamm, LLC is not responsible for the reliability of family information. The correctness of information provided to the ProStamm program is the sole responsibility of each PRO. The PRO is responsible for all information representing the character and conduct of people identified in their family record.

Termination

The user has the right to terminate the use of ProStamm, LLC services at any time. When terminated, the family record will be categorized as suspended.

The user has access to the financial portion of the program for the seven calendar days after the date of termination. This will allow the user to reconsider the termination and the ability to reestablish a new subscription without the loss of their family record.

The user understands that if s/he chooses not to renew their subscription within the seven calendar days’ grace period, the family record will be permanently removed from the ProStamm data base with no way to recover information.

ProStamm, LLC will terminate a user’s access to the ProStamm program, if the user elects to discontinue paying the subscription’s financial requirements.

If the user terminates prior to the end of their subscription period, they may be refunded the unused portion of that which was paid for that subscription period, minus an administrative processing fee of $50.

All subscriptions are set up for automatic credit card payments. If a user fails to cancel their subscription, the next payment will be automatically processed. The user is responsible to terminate a subscription if s/he doesn’t wish to continue ProStamm, LLC services.

Once a subscription comes up for renewal, the user will automatically be notified, via message window in the ‘Subscription Plan’ partition in the Admin section stating, ‘Your current pay is (Monthly/Annually) – expiring (day/month/year). It will automatically renew and charge your credit card on (day/month/year), unless you cancel.’ There is also a ‘Cancel Subscription’ button inside the message window.

A PRO subscription termination will automatically terminate every FCF and FCL subscription associated with that PRO.

Unused prepaid accounts are not subject to reimbursements.

If a PRO subscription is terminated and the successor decides to proceed with the family record as the PRO, the successor must submit a written statement, via email (Support@ProStamm.com) declaring their desire to be the PRO. The successor will be required to register as the new PRO of an existing family record and initiate a new PRO monthly/annual payment plan.

ProStamm, LLC reserves the right, in its sole discretion, to terminate a user’s access to the ProStamm website with prior notification.

ARCHIVE

The user has the ability to archive, rather than delete their family record, which will place everything into a state of suspension – ARCHIVE status.

When a family record is in archive status, the record is on hold and not accessible to the PRO, FCF, and FCL until the family record is reactivated. Only the PRO or the designated successor may reactivate the family record. The reactivation changes the ARCHIVE status to ACTIVE status.

A non-refundable admin fee of $50 will be automatically charged on the day of the request to archive as well as the beginning of every new annual subscription cycle.

The PRO may access the family record at any time to change the record status by logging into ProStamm and engaging the Admin section.

The ProStamm website may offer links to affiliate and/or other websites (Linked Sites) for the benefit of the user. The Linked Sites are not under the control of ProStamm, LLC and thus not responsible for their contents.
